This is a recording from 2024 of the WV LTAP's Tort Liability/Risk Management Class. The entire class should take approximately 6 hours to complete. OVERVIEW This class provides an overview of the legal duties and responsibilities of roadway personnel. Key legal concepts relating to the liability of roadway agencies are reviewed from a risk management standpoint. Common types of claims/lawsuits brought against street departments and roadway agencies are identified through examples and case studies. Risk management principles, aimed at 1) reducing and preventing crashes and claims and 2) helping agencies defend claims will be highlighted. Practical risk management activities will also be identified. OBJECTIVES Upon completion of the class, attendees should be able to: - Understand the elements of a tort claim - Understand agency and employee liability - Understand the tort claims process - Understand the principles of risk management - Understand measures to reduce the risk of tort liability AUDIENCE This class should be of interest to roadway engineers and technicians (involved in design, construction, traffic operations, and maintenance), public works directors, roadway maintenance supervisors, and elected/appointed officials.
